Article 1 - Definitions

In these terms and conditions, the following definitions apply:

Auralions: The trade name under which the Entrepreneur operates the online store at www.auralions.com

Consumer: The natural person not acting in the exercise of a profession or business who enters into a distance contract with the Entrepreneur

Cooling-off Period: The period within which the Consumer can exercise their right of withdrawal

Day: Calendar day

Digital Content: Data produced and delivered in digital form

Distance Contract: An agreement whereby, within the framework of a system organized by the Entrepreneur for the distance sale of products, exclusive use is made of one or more means of distance communication up to and including the conclusion of the agreement

Durable Medium: Any tool - including email - that enables the Consumer or Entrepreneur to store information addressed to them personally in a way that allows future consultation or use for a period appropriate to the purpose for which the information is intended, and which allows unaltered reproduction of the stored information

Entrepreneur: The natural or legal person offering products through www.auralions.com

Right of Withdrawal: The possibility for the Consumer to withdraw from the distance contract within the cooling-off period

Article 3 - Applicability

  • These general terms and conditions apply to every offer made by Auralions and to every distance contract concluded between Auralions and the Consumer.
  • Before the distance contract is concluded, the text of these general terms and conditions will be made available to the Consumer electronically in such a way that it can be easily stored by the Consumer on a durable medium.
  • These terms and conditions are available in English. Translations in other languages are for convenience only; in case of discrepancies, the English version prevails.
  • In addition to these general terms and conditions, specific product or service conditions may apply. In the event of conflicting terms, the Consumer may always invoke the applicable provision that is most favorable to them.
  • If one or more provisions in these general terms and conditions are void or voidable at any time, the agreement and these terms and conditions will otherwise remain in force.

Article 4 - The Offer

  1. All offers are non-binding unless explicitly stated otherwise. Auralions reserves the right to change and adjust the offer.
  2. The offer contains a complete and accurate description of the products offered. The description is sufficiently detailed to allow a proper assessment by the Consumer.
  3. All images and specifications in the offer are indicative and cannot give rise to compensation or dissolution of the agreement. Images are a true representation of the products offered; however, Auralions cannot guarantee that displayed colors exactly match the actual colors of the products.
  4. Each offer contains clear information about:
    • The price excluding customs duties, import taxes, and VAT (see Article 9)
    • Shipping costs
    • Payment methods accepted
    • Delivery information and timing
    • The applicability of the right of withdrawal and its limitations
    • Product specifications including volume and fragrance notes

Article 5 - The Agreement

  1. The agreement is concluded, subject to paragraph 4, at the moment of acceptance by the Consumer of the offer and compliance with the corresponding conditions.
  2. If the Consumer has accepted the offer electronically, Auralions will immediately confirm receipt of the acceptance electronically. The Consumer can cancel the agreement as long as this confirmation has not been sent.
  3. Auralions implements appropriate technical and organizational measures to secure the electronic transfer of data and ensures a secure web environment. Secure payment methods are used for electronic payments.
  4. Auralions reserves the right to refuse orders or to attach special conditions to delivery if:
    • There are reasonable doubts about the Consumer's ability to meet payment obligations
    • The delivery address is in a country with import restrictions for perfume products
    • Previous orders have resulted in payment or delivery issues
  5. Upon delivery, Auralions will provide the Consumer with the following information in writing or electronically:
    • Order confirmation with product details
    • Information about the right of withdrawal and its limitations
    • Contact information for customer service
    • Tracking information for the shipment

Article 6 - Right of Withdrawal

  1. When purchasing products, the Consumer has the right to dissolve the agreement without giving reasons within 30 days. This cooling-off period starts on the day after the Consumer or a representative designated by the Consumer receives the product.
  2. During the cooling-off period, the Consumer will handle the product and packaging with care. The product may only be unpacked or used to the extent necessary to assess whether they wish to keep the product.
  3. IMPORTANT LIMITATION: Due to hygiene and safety regulations, the right of withdrawal does NOT apply to perfume products where the seal has been broken or the product has been opened. Once the protective seal is removed, the product cannot be returned.
  4. To exercise the right of withdrawal, the Consumer must notify Auralions in writing (e.g., by email) within 30 days of receiving the product.
  5. The Consumer must return the product within 30 days of notifying their intention to withdraw. The Consumer must provide proof of timely return, for example through a shipping receipt.

Article 7 - Costs in Case of Withdrawal

  1. If the Consumer exercises their right of withdrawal, they bear only the direct costs of returning the products.
  2. Auralions will reimburse payments received from the Consumer as soon as possible, but no later than 30 days after return or withdrawal, provided the product has been received back or conclusive proof of return has been provided.
  3. Auralions will use the same payment method used by the Consumer for reimbursement unless the Consumer agrees to a different method.

Article 8 - Exclusion of Right of Withdrawal

The right of withdrawal is excluded for:

  1. Perfume products where the seal has been broken - Once the protective seal or cellophane wrapping is removed, the product cannot be returned for hygiene and safety reasons
  2. Products that have been custom-made or personalized according to Consumer specifications
  3. Products that can deteriorate or age rapidly
  4. Products where the Consumer has removed labels, tags, or other identifying marks

Article 9 - Price and Import Duties

  1. Product Prices: All prices displayed on the Website are in EUR/USD and EXCLUDE:
    • Import duties and customs fees
    • Local VAT/GST/Sales tax
    • Handling fees charged by postal or courier services
  2. Import Tax Responsibility:
    • The Consumer is fully responsible for all import duties, taxes, and fees in their country
    • These charges are collected by the postal or courier service upon delivery
    • Auralions has no control over these charges and cannot predict their amount
    • The Consumer must pay these charges to receive their order
  3. Delivery Process:
    • Products are shipped directly from our international fulfillment center
    • The postal/courier service will handle customs clearance
    • The Consumer will be contacted by the carrier for payment of import charges
    • Refusal to pay import charges will result in the package being returned
  4. Price changes are reserved, particularly due to:
    • Currency exchange rate fluctuations
    • Changes in supplier prices
    • Typing or programming errors

Article 10 - Conformity and Warranty

  1. Auralions warrants that products comply with the agreement, specifications stated in the offer, reasonable requirements of reliability and usability, and existing legal provisions.
  2. Authenticity Guarantee: All perfumes sold through Auralions are 100% authentic and sourced from authorized suppliers.
  3. Defects or incorrectly delivered products must be reported to Auralions in writing within 30 days of delivery.
  4. The warranty period corresponds to the manufacturer's warranty period for perfume products.
  5. The warranty does not apply if:
    • The Consumer has modified or damaged the product
    • The product has been exposed to extreme temperatures or conditions
    • The product has been stored improperly
    • The defect results from normal wear and tear

Article 11 - Delivery and Fulfillment

  1. Auralions will exercise the utmost care when receiving and fulfilling product orders.
  2. The place of delivery is the address provided by the Consumer.
  3. Orders are fulfilled with due speed but no later than 30 days unless a different delivery period has been agreed.
  4. International Shipping:
    • Delivery times vary by destination (typically 7-14 business days)
    • Tracking information will be provided via email
    • Auralions is not responsible for delays caused by customs procedures
  5. If delivery is delayed or an order cannot be fulfilled, the Consumer will be notified within 30 days of placing the order and has the right to cancel the order without costs.
  6. The risk of damage and/or loss of products rests with Auralions until the moment of delivery to the Consumer or a designated representative.

Article 12 - Payment

  1. Payment must be made at the time of order through the available payment methods on the Website.
  2. Accepted payment methods include:
    • Credit cards (Visa, MasterCard, American Express)
    • PayPal
    • Other methods as indicated on the Website
  3. The Consumer is obligated to immediately report inaccuracies in payment details to Auralions.
  4. All payments are processed securely through encrypted connections.

Article 13 - Shipping Restrictions

  1. Prohibited Destinations: Due to international regulations on perfume shipping, Auralions cannot ship to certain countries. A current list is available on the Website.
  2. Air Transport Restrictions: Perfumes containing alcohol are classified as dangerous goods for air transport. This may affect:
    • Shipping methods available
    • Delivery times
    • Shipping costs
  3. Age Restrictions: By placing an order, the Consumer confirms they are at least 18 years old or the legal age in their jurisdiction to purchase perfume products.

Article 14 - Complaints Procedure

  1. Complaints about order fulfillment must be submitted to Auralions fully and clearly described within 7 days of discovering the defects.
  2. Complaints can be submitted via email to info@auralions.com.
  3. Complaints submitted to Auralions will be answered within 30 days of receipt. If a complaint requires a longer processing time, Auralions will respond within 30 days with a notice of receipt and an indication of when a more detailed answer can be expected.
  4. The Consumer must give Auralions at least 4 weeks to resolve the complaint in mutual consultation.

Article 15 - Disputes and Applicable Law

  1. These terms and conditions and all agreements between Auralions and the Consumer are exclusively governed by Dutch law.
  2. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.
  3. Disputes will first be attempted to be resolved through mutual consultation.
  4. If consultation does not lead to a solution, disputes will be submitted to the competent court in the Netherlands, unless mandatory consumer protection laws designate another court.
  5. The Consumer always retains the right to choose the competent court according to applicable consumer protection laws.

Article 16 - Privacy and Data Protection

  1. Auralions processes personal data in accordance with applicable privacy legislation, including the GDPR.
  2. Personal data is used only for:
    • Order processing and delivery
    • Customer service
    • Legal obligations
    • Marketing communications (with consent)

Article 17 - Intellectual Property

  1. All intellectual property rights to the Website, brand name "Auralions", logos, images, and content remain with Auralions.
  2. The Consumer may not copy, distribute, or use any content without explicit written permission.

Article 18 - Force Majeure

  1. Auralions is not liable for delays or failures in performance due to circumstances beyond its reasonable control, including but not limited to:
    • Natural disasters
    • Pandemic restrictions
    • Government actions or trade restrictions
    • Carrier delays or strikes
    • Supplier failures
  2. In case of force majeure, Auralions will notify the Consumer and may suspend or cancel orders with full refund.

Article 19 - Amendments

  1. Auralions reserves the right to amend these terms and conditions.
  2. Amendments apply to new orders placed after the amendment date.
  3. The version of the terms and conditions applicable at the time of order placement governs that transaction.
